1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client", "you", or "your") and RDBS Transport & Logistics ("RDBS", "we", "our", or "us") regarding your use of our website and transport services.

By accessing our website or using our services, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our services.

3. Services

RDBS provides transport and logistics services including but not limited to:

  • Express delivery services with van fleet
  • Standard transport services for various cargo sizes
  • Full truckload (FTL) transport services
  • Logistics and route planning
  • Real-time shipment tracking

Services are subject to availability and may vary based on location, cargo type, and specific requirements.

4. Service Requests and Quotes

4.1 Quote Requests

Clients may request quotes through our website, email, or phone. Quotes are provided based on information supplied by the Client and are valid for 30 days unless otherwise stated.

4.2 Booking Confirmation

A transport service is confirmed only when RDBS issues a written confirmation (email or booking reference). Verbal agreements must be confirmed in writing to be valid.

5. Client Obligations

The Client agrees to:

  • Provide accurate and complete information about the cargo (weight, dimensions, nature, value)
  • Ensure proper packaging and labeling of goods
  • Provide all necessary documentation (CMR, customs documents, permits)
  • Ensure goods comply with all applicable laws and regulations
  • Be available at pickup and delivery locations at agreed times
  • Declare any hazardous, fragile, or special handling requirements
  • Provide accurate loading and unloading addresses with contact persons

6. Prohibited Items

RDBS will not transport the following items without prior written agreement and appropriate permits:

  • Illegal substances or contraband
  • Hazardous materials (without proper classification and documentation)
  • Live animals (except with specific arrangements)
  • Perishable goods requiring special temperature control (without proper equipment)
  • Items prohibited by law or customs regulations
  • Weapons, ammunition, or explosives (without proper permits)

7. Pricing and Payment

7.1 Pricing

Prices are quoted in Euros (EUR) and exclude VAT unless otherwise stated. Additional charges may apply for:

  • Waiting time beyond agreed periods
  • Special handling or equipment
  • Tolls, ferry fees, and permits
  • Storage or demurrage charges
  • Customs clearance services

7.2 Payment Terms

Unless otherwise agreed in writing:

  • Payment is due within 30 days of invoice date
  • Late payments may incur interest charges at the legal rate
  • RDBS reserves the right to suspend services for overdue accounts
  • Payment methods: bank transfer, approved business accounts

8. Delivery and Transit Times

Estimated delivery times are provided in good faith but are not guaranteed unless expressly agreed in writing as "guaranteed delivery". Transit times may be affected by:

  • Weather conditions and force majeure events
  • Traffic delays and road closures
  • Customs and border clearance procedures
  • Technical issues or vehicle breakdowns
  • Delays caused by the sender or receiver

9. Liability and Insurance

9.1 Carrier Liability

RDBS liability is governed by the CMR Convention (Convention on the Contract for the International Carriage of Goods by Road) for international transport and Belgian law for domestic transport. Maximum liability is limited to 8.33 SDR (Special Drawing Rights) per kilogram of gross weight of goods lost or damaged.

9.2 Insurance

RDBS maintains appropriate carrier liability insurance. Clients transporting high-value goods are advised to arrange additional cargo insurance. We can assist with insurance arrangements upon request.

9.3 Claims

Claims for loss or damage must be:

  • Noted on the delivery receipt at the time of delivery
  • Reported in writing within 7 days for visible damage
  • Reported in writing within 21 days for concealed damage
  • Supported by photographic evidence and proof of value

10. Force Majeure

RDBS shall not be liable for failure to perform obligations due to circumstances beyond reasonable control, including but not limited to: natural disasters, war, strikes, government actions, pandemics, extreme weather, or infrastructure failures. In such cases, performance will be suspended until circumstances permit, or the contract may be terminated without liability.

11. Cancellation Policy

Cancellation charges apply as follows:

  • More than 24 hours before pickup: No charge
  • 12-24 hours before pickup: 25% of agreed price
  • Less than 12 hours before pickup: 50% of agreed price
  • No-show at pickup: 100% of agreed price

12. Data Protection

RDBS processes personal data in accordance with our Privacy Policy and applicable data protection laws including GDPR. By using our services, you consent to such processing.

13. Intellectual Property

All content on the RDBS website, including text, graphics, logos, and images, is the property of RDBS Transport & Logistics and protected by copyright and trademark laws. Unauthorized use is prohibited.

14. Limitation of Liability

To the maximum extent permitted by law, RDBS shall not be liable for:

  • Indirect, consequential, or incidental damages
  • Loss of profits, business, or opportunities
  • Delays in delivery except where guaranteed in writing
  • Damage caused by improper packaging by the sender
  • Loss or damage to goods with undeclared or misrepresented value

15. Dispute Resolution

Any disputes arising from these Terms or our services shall be resolved through good faith negotiations. If negotiations fail, disputes shall be subject to the exclusive jurisdiction of the courts of Antwerp, Belgium, and governed by Belgian law.

For international transport, the CMR Convention shall apply where applicable.

16. Modifications to Terms

RDBS reserves the right to modify these Terms at any time. Updated Terms will be posted on our website with a revised "Last updated" date. Continued use of our services after changes constitutes acceptance of modified Terms.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy and Transport Conditions, constitute the entire agreement between you and RDBS regarding the use of our services and supersede all prior agreements and understandings.
